By applying to become a member or participating in a Whiskies of the Glen Bargain Bid as a Whiskies of the Glen Bargain Bid member, You agree to be bound by these terms and conditions alone.
The Whiskies of the Glen Bargain Bid is intended for private individuals only.
You are not eligible to become a member of the Whiskies of the Glen Bargain Bid, or to make a bid in any Whiskies of the Glen Bargain Bid if:
- You are a Company or Business and it is your intention to sell or offer or arrange for sale any controlled liquor offered by Whiskies of the Glen as Bargain Bid Goods to a third party as part of your business activities.
- You are a Revenue Trader and it is your intention to sell or offer or arrange for sale any controlled liquor offered by Whiskies of the Glen as Bargain Bid Goods to a third party.
- You are a Wholesaler or Agent business (see definitions) and it is your intention to sell or offer or arrange for sale any controlled liquor offered by Whiskies of the Glen as Bargain Bid Goods to a third party as part of your business activities.
Whiskies of the Glen reserves the right to change or update these terms and conditions from time to time and at any time.

DELIVERY BY WHISKIES OF THE GLEN
Whiskies of the Glen offers Free Delivery to addresses within mainland UK.
Free Delivery of Whiskies of the Glen Bargain Bid Goods through Whiskies of the Glen applies to mainland UK only. Should the Buyer be an overseas resident and wish to receive their Goods at an address outside of the UK, shipping and insurance charges will apply.
Local receiving country Taxes and Duty charges may apply to Goods being shipped outside of the UK and are all chargeable to, and payable by the Buyer.
If the Controlled Liquor is to be exported under bond, Duty and VAT can be suspended (but not avoided). Government taxes would be payable in the country of final destination, at the rates prevailing in that country at that time. When applicable, it is up to the Customer to find a suitable importer in the destination country and to arrange the export.
Please note it is the responsibility of the Customer to comply with all import regulations prevailing in the country of final destination regarding the importation of alcohol.
BEFORE YOU BID IN A WHISKIES OF THE GLEN BARGAIN BID
- You must be a member of the Whiskies of the Glen Bargain Bid.
- Any Whiskies of the Glen Bargain Bid Bids You make must be in Pounds Sterling.
- You must satisfy the Whiskies of the Glen qualifying age requirements.
- You may only make a bid using a Whiskies of the Glen Bargain Bid bidding form.
- You may only Submit a bid for an Available Lot.
- You must complete all of the mandatory fields (including accepting the terms governing Your Bid) in the Whiskies of the Glen Bargain Bid bidding form before clicking the ‘SUBMIT’ button.
- By clicking the ‘Submit’ button, You are submitting Your Whiskies of the Glen Bargain Bid bidding form to Whiskies of the Glen.
- In order to become a member and Bid in a Whiskies of the Glen Bargain Bid, You must first accept these Whiskies of the Glen bargain Bid terms and conditions.
FINANCIAL RESPONSIBILTY
As a member of the Whiskies of the Glen Bargain Bid, You will pay immediately or Upon Demand to Whiskies of the Glen the sum of any Winning or Highest Bid submitted from Your member account that is confirmed and notified to you by Whiskies of the Glen as the single Winning or Highest Bid of a single Bargain Bid. The particular Bargain Bid being identified by its Bid Reference.
DEADLOCKED BIDS
If Your Bid is selected as the Highest Bid but it is Deadlocked with one or more other Bids, You will be invited by a Whiskies of the Glen email to increase Your Bid. This process shall continue until:
- A single Highest Bid remains, or
- All of the remaining members identified by the Whiskies of the Glen software as holding the Highest Bid (having received the Whiskies of the Glen email invitation to increase their Bid), decline the Whiskies of the Glen email invitation to increase their Bid.
If You receive an email invitation from Whiskies of the Glen but you decide not to increase your bid, the Current last Bid You have made will not be considered for random selection by the Whiskies of the Glen software as the Highest Bid unless all the other remaining members identified by the Whiskies of the Glen software as holding the Highest Bid at that time, each of them having been sent the last Whiskies of the Glen email invitation to increase their Bid, decide not to increase their Bid.
In the case where all of the remaining members identified by the Whiskies of the Glen software as holding the Highest Bid (having received the Whiskies of the Glen email invitation to increase their Bid), decide not to increase their Bid and the Highest Bids remain in Deadlock, the Whiskies of the Glen software will randomly select the Winning Highest Bid from the remaining members that have declined the last email invitation sent by Whiskies of the Glen to the last remaining members holding the highest bid to increase their Bid and that continue to hold the Highest Bid with one or more other members.
If you are identified as holding the Winning or Highest Bid, Whiskies of the Glen will send you a notification email formally accepting your Bid for the Bargain Bid lot.
Once you have made your Bid payment for the lot, title to the goods will pass to You and the item prepared and readied for dispatch and your possession.
IMPORTANT INFORMATION
The amount you have Bid will not be published during the bidding phase.
Whiskies of the Glen will only publish the amount of the Winning Highest Bid.
Whiskies of the Glen will not publish any of Your personal details, such as Your name, without first obtaining your written consent.
DEFINITIONS
Whiskies of the Glen (The Company, Our, We, Us, It) means Whiskies of the Glen (WOTG) Company reg No. 11100190, VAT Reg No. 346 0388 96, its website www.whiskiesoftheglen.com, its email, interent accounts, and any of its subsidiaries.
Website means a Website address operated by Whiskies of the Glen including but not limited to, www.whiskiesoftheglen.com
Internet Account means an internet account operated by Whiskies of the Glen such as Facebook, Twitter, and any other online internet account used by Whiskies of the Glen to promote a Whiskies of the Glen Bargain Bid or Whiskies of the Glen Goods.
Whiskies of the Glen Classic Bargain Bid, Whiskies of the Glen Bargain Bid, or Bargain Bid means any Bargain Bid or Bargain Bid service emanating from Whiskies of the Glen, a Whiskies of the Glen website, a Whiskies of the Glen email, or a Whiskies of the Glen internet account.
Business Day means any weekday between the hours of 09.00 and 17:00 except if that day falls on a United Kingdom National Holiday or Bank Holiday.
You also includes Your, or any derivative thereof, and means You as a Bidding Member of the Whiskies of the Glen Bargain Bid, or a as a Bidding Member applicant to the Whiskies of the Glen Bargain Bid.
Bidding Member means any member of the Whiskies of the Glen Bargain Bid.
Controlled Liquor means any alcohol product that has been classified as Controlled Liquor by HMRC.
Wholesaler or Agent business (including but not limited to; a cash and carry, a merchant or broker, a producer supplying Controlled Liquor products to the trade, a retailer that also wholesales, an auctioneer arranging a wholesale sale, agents in the sale of alcohol) means a person or entity wishing to offer or arrange for sale any Controlled Liquor products offered by Whiskies of the Glen, to a third party as part of their business activities.
Bid Reference means a unique reference number that a Bargain Bid may be identified by.
Identified Whiskies of the Glen Bargain Bid or identified Bargain Bid means a Bargain Bid that is identified by its Bid Reference.
The Parties means Whiskies of the Glen and You.
Buyer or Customer means any Bidding Member of the Whiskies of the Glen Bargain Bid holding a Winning or Highest Bid in respect of Goods offered through an Identified Whiskies of the Glen Bargain Bid.
Place of Residence means a country you are currently residing in.
Qualifying Age means the age at which it is legal to purchase, to receive, to possess, or to consume an alcoholic drink of any kind, or the age at which it is legal to purchase, to receive, to possess, to consume, or to use, goods of any type in Your Place of Residence.
Whisky means whisky or whiskey.
Goods means, a) an item, b) an alcoholic drink or alcoholic drinks of any type including, labelling, closure(s), and packaging, or c) goods of any type, offered in a Whiskies of the Glen Bargain Bid.
Deliver, Delivered, Delivery, Shipment, or any derivative thereof, means the delivery of Whiskies of the Glen Bargain Bid Goods to the Buyer, by whiskies of the Glen or its delivery agents.
Bargain Bid Registration Form means a registration form provided to You by Whiskies of the Glen and emanating from a Whiskies of the Glen Website, email, or internet account, by which You may make Your application to Whiskies of the Glen to become a Bidding Member of the Whiskies of the Glen Bargain Bid.
Application means Your completion and submission of a Whiskies of the Glen Bargain Bid Registration Form to Whiskies of the Glen.
Membership of the Whiskies of the Glen Bargain Bid means that You are a Bidding Member of the Whiskies of the Glen Bargain Bid.
Membership Number means a unique number that may be allocated and given by Whiskies of the Glen to a Bidding Member of the Whiskies of the Glen Bargain Bid.
Bargain Bid Member Account means a Whiskies of the Glen Bargain Bid members account and / or a Whiskies of the Glen Bargain Bid account belonging to a Bidding Member of the Whiskies of the Glen Bargain Bid.
Bargain Bid Bidding Form means a Bargain Bid Bidding Form provided to You by Whiskies of the Glen emanating from a Whiskies of the Glen Website, email, or internet account, by which a Bidding Member may make a Bid in a Whiskies of the Glen Bargain Bid.
Bargain Bid Opening Time means the designated Bid opening time of an item offered in a Whiskies of the Glen Bargain Bid as stipulated by Whiskies of the Glen.
Bargain Bid Closing Date and Time means the designated closing Bid Date and Time or the time remaining indication of an item offered in a Whiskies of the Glen Bargain Bid as stipulated by Whiskies of the Glen.
Time Remaining means a) The amount of Time Remaining until a Bargain Bid Closing Date and Time, or when applicable, b) The time shown on an identified Bargain Bid’s Time Remaining clock.
Available Lot means a Bargain Bid item that is available to make a Bid on by a Bidding Member of the Whiskies of the Glen Bargain Bid between its stated Bargain Bid Opening Time and Bargain Bid Closing Date and Time, or when applicable, before the time elapses on its Bargain Bid Time Remaining clock.
Open for Bids means the time between a Bargain Bid Opening Time and a Bargain Bid Closing Date and Time, or when applicable, before the time elapses on the Bargain Bid Time Remaining clock.
Bid means an amount of money offered by You as payment for Goods in a Whiskies of the Glen Bargain Bid. A Bid may be made and Submitted by Bidding Members of the Whiskies of the Glen Bargain Bid only, by the bidding member completing all the mandatory fields of a Whiskies of the Glen Bargain Bid Bidding Form. Bids may only be made and Submitted between the Bargain Bid Opening Time and Bargain Bid Closing Date and Time of the Goods being Bid for. Your Bid must be Accepted by Whiskies of the Glen before You can become the Buyer of the Goods You have made Your Bid for.
Current Bid means the latest or most recently placed single Bid of a Bidding Member of the Whiskies of the Glen Bargain Bid in an Identified Whiskies of the Glen Bargain Bid that Whiskies of the Glen may consider for selection and formal Acceptance as the Winning or Highest Bid of the identified Bargain Bid.
Changing a Bid means a Biding Member’s use of the procedure in section 4 of these Terms and Conditions.
Changed Bid means a Bid that has been Changed, by the Bidding member following the Changing a Bid procedure in section 4 of these Terms and Conditions.
Silent Bid means a Bid that shall not be published until a Winning or Highest Bid has been selected by Whiskies of the Glen.
Upon Demand means upon any notification (no matter how given) from Whiskies of the Glen to the Buyer that their payment for a Bargain Bid item they have made a Bid for, is due to Whiskies of the Glen. (That Bid having been accepted by Whiskies of the Glen as the Highest Winning Bid of the Identified Whiskies of the Glen Bargain Bid).
Deadlock or Deadlocked means when two or more Whiskies of the Glen selected Winning Highest Bids for an Identified Whiskies of the Glen Bargain Bid are for identical financial amounts.
Winning Bid or Highest Bid means any Bid that is selected and formally Accepted by Whiskies of the Glen, by whatever means, as the winning or highest bid in an Identified Whiskies of the Glen Bargain Bid.
Accepted Bid means a Bidding member’s Bid for Goods that is officially accepted by Whiskies of the Glen as the winning or highest bid in an Identified Whiskies of the Glen Bargain Bid by the issuance by Whiskies of the Glen of a Confirmation Email to the email address of the Bidding Member of the accepted Bid.
Confirmation Email means the email sent by Whiskies of the Glen to the email address of the holder of the accepted Bid by which Whiskies of the Glen officially confirms accepts the Bid submitted to it by the member in an Identified Whiskies of the Glen Bargain Bid.
Completion means when the Buyer has paid the amount of their Accepted Bid including surcharges in an Identified Whiskies of the Glen Bargain Bid in full and no amount is left outstanding.
Buyer Appointee means an individual meeting the Qualifying Age (as is required by Whiskies of the Glen), who has been appointed by the Buyer to receive delivery of the Goods at the appointed delivery address.
VAT means Value Added Tax; it is applicable in the UK and is payable by a Buyer of goods upon which VAT is chargeable.
Duty means a sum calculated and charged as Duty by HMRC and is payable by the Buyer of goods upon which Duty is chargeable.
In Bond (IBD) means duty and tax suspended Goods held in an HMRC approved warehouse or other appropriately authorised storage facility.
Force Majeure means an event or outcome that cannot be controlled.
Surcharge means a sum added to the price.
Delivery Charge means the amount payable to Whiskies of the Glen for delivery of the Goods.
Issued to You by Whiskies of the Glen means having been issued, supplied, or delivered to You by Whiskies of the Glen, through their Website, In writing by Whiskies of the Glen, by a Whiskies of the Glen email, or through an internet account belonging to Whiskies of the Glen.
- Whiskies of the Glen Bargain Bid
- Whiskies of the Glen provides the Whiskies of the Glen Bargain Bid through the Whiskies of the Glen website, by email from Whiskies of the Glen, and through internet accounts operated by whiskies of the Glen.
- Not all Goods offered and sold in a Whiskies of the Glen Bargain Bid are in new or mint condition. Due to the demands of the market, Goods offered may be antiquities or their production may have been discontinued and they may exhibit signs of wear and tear. Whiskies of the Glen tries to provide such information regarding the condition of the Goods in the description of the Goods. Images of the goods, however and wherever published by Whiskies of the Glen, are for illustrative purposes only, and may not accurately represent the Goods or the condition of Goods.
- You must satisfy the Whiskies of the Glen Qualifying Age requirements.
- Membership
- You are required to be a Bidding Member of the Whiskies of the Glen Bargain Bid before You are able to make a Bid for any Whiskies of the glen Bargain Bid offering.
- To apply, or to become a Bidding Member of the Whiskies of the Glen Bargain Bid, You must satisfy the Whiskies of the Glen Qualifying Age requirements.
- You may make Your Application to become a Bidding Member of the Whiskies of the Glen Bargain Bid by using the Bargain Bid Application Form provided by Whiskies of the Glen through its Website, email, or internet accounts.
- Upon Your successful application to become a Biding Member of the Whiskies of the Glen Bargain Bid, You will be able to make Bids to purchase any of the Goods offered in any Whiskies of the Glen Bargain Bid. Whiskies of the Glen reserves the right to reject any Bid made by You in a Whiskies of the Glen Bargain Bid if it does not comply with these terms and conditions.
- During Your registration to become a Bidding Member of the Whiskies of the Glen Bargain Bid, You may be asked to give personal information including but not limited to, Your name (as it appears on Your passport), Your residential address (Your billing address and delivery address), Your email address, Your date of birth and Your mobile telephone number.
- Whiskies of the Glen may require further details from You that are deemed necessary to enable it to carry out an online credit check.
- All of Your personal data will be kept by Whiskies of the Glen and will not be shared with any other business or organisation. Your details shall be kept in compliance with the most recent official UK Data Protection Act.
- Whiskies of the Glen reserves the right to reject any application made to it to become a Bidding Member of its Bargain Bid.
- Making a Bid in the Whiskies of the Glen Bargain Bid
- You are required to be a Bidding Member of the Whiskies of the Glen Bargain Bid before You are able to make a Bid on any Whiskies of the glen Bargain Bid offering.
- A Bid for goods in a Whiskies of the Glen Bargain Bid may only be made by You between the designated Bargain Bid Opening Time and the Bargain Bid Closing Time, or when applicable, before the time elapses on the Bargain Bid Time Remaining clock, using a Whiskies of the Glen Bargain Bid Bidding Form that has been made available to You by Whiskies of the Glen.
- Each Bid submitted by You to Whiskies of the Glen is regarded by Whiskies of the Glen as a Silent Bid.
- Any Bid that is officially Accepted by Whiskies of the Glen and this Bid is notified to you by email from Whiskies of the Glen, this Bid must be honoured by You.
- Changing a Bid
- Login to your Whiskies of the Glen Bargain Bid Membership Account.
- Go to ‘YOUR ACTIVE BIDS’.
- Identify the Bargain Bid Lot you wish to increase your Bid for.
- Make sure that the Bargain Bid you wish to change is still Open for Bids.
- Click on the ‘CHANGE MY BID’ button.
- Write in your increased Bid in the ‘PLACE YOUR BID’ box.
- Agree to the terms of your Bid and Submit your new Bid.
- Upon submission, your increased bid will become your Current Bid. Only one Current Bid is permitted per Bidding Member. Whiskies of the Glen shall only accept Your most recent Bid submission as Your Current Bid.
- Removing a Bid
- If You wishes to remove a Bid, You must immediately email Whiskies of the Glen at enquire@whiskiesoftheglen.com stating that You wish to remove their Bid.
- In removing a Bid, the Member must quote their name, and when applicable, their Whiskies of the Glen Bargain Bid Membership Number, the Identified Whiskies of the Glen Bargain Bid Lot they wish to remove their Bid for, the date of their Bid submission to whiskies of the Glen, and the monetary amount of the Bid they wish to remove.
- Removing a Bid will effectively cancel that Bid.
- How Whiskies of the Glen accepts a Bid
- Whiskies of the Glen will only accept a Bid for Goods being made available by It in a Bargain Bid, when the Bid is submitted to It, and received by It, during period the that the Bargain Bid is Open for Bids.
- In officially accepting a Bid, Whiskies of the Glen will notify the Bidding Member of its acceptance of their Bid by Confirmation Email.
- Upon officially accepting a Bid, Whiskies of the Glen will make the Goods available exclusively to the Bidding Member that submitted The Accepted Bid so that the Bidding Member may complete their purchase of the Goods.
- The decision to Accept a Bid for Goods in any Identified Whiskies of the Glen Bargain Bid remains exclusively with Whiskies of the Glen.
- Qualifying Age
- As a Bidder or Buyer of Goods in a Whiskies of the Glen Bargain Bid, You must meet the Whiskies of the Glen Qualifying Age requirements.
- In order to prevent Fraud and illegal activity of any kind, including but not limited to underage alcohol purchases, Whiskies of the Glen Reserves the right to request from the Buyer, an officially recognised document such as but not limited to, a passport or a driving license, (a) as proof that the Buyer meets the Qualifying Age as is required by Whiskies of the Glen and (b) to correctly identify the Buyer.
- Buyers Terms and Conditions
- In accepting these Terms and Conditions You acknowledge and agree that You shall be liable for the security of Your Whiskies of the Glen Bargain Bid membership account.
- In accepting these Terms and Conditions You acknowledge and agree that any Bid or Changed Bid for Goods offered in a Whiskies of the Glen Bargain Bid that has been submitted to Whiskies of the Glen using Your Whiskies of the Glen Bargain Bid members account shall be binding upon You, irrevocable, and payable by You.
- In accepting these Terms and Conditions You acknowledge and agree that You shall settle in full and on time any financial payment or obligation arising from Whiskies of the Glen’s Acceptance of a Bid as the Winning or Highest Bid of an Identified Whiskies of the Glen Bargain Bid in which the Winning or Highest Bid has been submitted using Your Whiskies of the Glen Bargain Bid members account.
- A description (in compliance with Whiskies of the Glen’s description format) of the Goods offered through a Whiskies of the Glen Bargain Bid is made available by Whiskies of the Glen under the description tab of the Goods offered.
- You are a Company or Business involved in the sale of Controlled Liquor and you intend to offer for sale or sell your Bargain Bid lot to a third party.
- You are a Revenue Trader involved in the sale of Controlled Liquor and you intend to offer for sale or sell your Bargain Bid lot to a third party.
- You are an agent involved in the offering for sale or the sale of Controlled Liquor and you intend to offer for sale or sell your Bargain Bid lot to a third party.
- You offer or arrange for the sale of Controlled Liquor to a third party and you intend to offer for sale or sell your Bargain Bid lot to a third party.
- Confirmation and Completion of purchase when a Bid is accepted by Whiskies of the Glen as the Highest or Winning Bid in an identified Bargain Bid
- Whiskies of the Glen will send a Confirmation Email to the Bidding Member Accepting the Bidding Member’s Bid for the Goods offered in an Identified Whiskies of the Glen Bargain Bid.
- The Buyer will pay the amount of their Accepted Bid in full.
- The purchase contract between Whiskies of the Glen and the Buyer shall be concluded upon Whiskies of the Glen receiving full payment for the Goods offered in an Identified Whiskies of the Glen Bargain Bid into its bank account, and the issuing and emailing by Whiskies of the Glen Bargain to the Buyer of a receipt of full payment in the purchase of the Goods offered in such an Identified Whiskies of the Glen Bargain Bid.
- Payment and fees
- Payment for the Goods must be made in full by the Buyer to Whiskies of the Glen prior to the release of the Goods by Whiskies of the Glen to the Buyer.
- Payments must be made by the Buyer to Whiskies of the Glen within five (5) working days of the Confirmation Email being sent by Whiskies of the Glen to the Buyer’s registered email address.
- Payment for the Goods can be made by either, Bank Transfer, Debit Card, or Credit Card.
- Upon Whiskies of the Glen receiving full payment for the Goods from the Buyer, the title to the Goods will pass to the Buyer, thereafter, Whiskies of the Glen will issue and email to the Buyer a receipt of payment in respect of the Goods.
- If the Buyer does not pay for the Goods within the time specified by Whiskies of the Glen, Whiskies of the Glen reserves the right to; (a) Prohibit the Buyer from using the Whiskies of the Glen Website and its services; any membership fee paid by the Buyer to Whiskies of the Glen will be refunded to the Buyer minus an appropriate Whiskies of the Glen administration fee, (b) Whiskies of the Glen may at its discretion cancel the sale of the Goods offered through its Bargain Bid that remain unpaid, and offer those Goods for sale by Tender or by any other means.
- If applied by Whiskies of the Glen, payments for Goods that remain outstanding by their due date will incur a late payment interest charge of 3% per month above the Bank of England base rate of interest on the outstanding balance, until the outstanding balance is paid in full, and can be proved or evidenced as such by the parties.
- In each case where Goods are offered and sold as ‘In Bond’ (IBD), Government Tax and Government Duty are the responsibility of the Buyer and are, in every possible scenario, payable by the Buyer.
- Buyer Appointee
- The Buyer must indicate in their response to the Delivery information email issued to them by Whiskies of the Glen that their Buyer Appointee will receive the delivery of the Goods. The Buyer must give full name and address details of their Buyer Appointee and ensure that their Buyer Appointee meets the Qualifying Age required by Whiskies of the Glen, and if required to do so, the Buyer or the Buyer Appointee should provide to Whiskies of the Glen a copy of the Buyer Appointee’s Driving Licence or an equivalent form of age proof or identification.
- Delivery of the Goods (UK)
- For deliveries through or by Whiskies of the Glen, Whiskies of the Glen reserves the right to choose the delivery company or agent. Whiskies of the Glen’s choice of delivery company or agent shall be final.
- Upon full payment for the Goods and any such applicable delivery fee and all surcharges for the Goods being received by Whiskies of the Glen, Whiskies of the Glen will have the goods delivered to a mainland UK address elected and detailed by the buyer.
- The Buyer, or a Buyer Appointee must be available to sign for the Goods upon their delivery.
- If the Buyer or the Buyer Appointee is unable to sign for, and receive, the Goods on the notified delivery date, the Buyer must contact Whiskies of the Glen immediately upon receiving the delivery notification to arrange an alternate delivery date. The Buyer shall be liable for any additional delivery costs incurred in the Buyer’s changing of the delivery date.
- If required prior to the Goods being released to them, or upon Delivery of the Goods, the Buyer or the Buyer Appointee must provide an officially recognised document such as, but not limited to, a passport or driving license as proof of Qualifying Age and identity.
- The Buyer acknowledges that Whiskies of the Glen shall not be held liable for any leakages, deterioration, damages and or breakages suffered by the Goods during transit or onward shipping to the Buyer.
- Delivery charges within the UK are inclusive of VAT.
- In this section 12 of these terms and conditions, Delivery of Whiskies of the Glen Bargain Bid Goods through Whiskies of the Glen applies to the UK only.
- Delivery of the Goods (Destinations other than mainland UK)
- Should the Buyer require that Whiskies of the Glen deliver their Goods to an address outside of mainland UK, Whiskies of the Glen Delivery and Insurance Charges will be payable by the Buyer to Whiskies of the Glen prior to the Shipping of their Goods by Whiskies of the Glen.
- The Buyer shall ensure that adequate transit or onward shipping insurance is in place to cover any damages or such eventualities, no matter how unlikely, prior to the Delivery of the Goods. Shipping information including destinations, Delivery Charges, and insurance charges is available from Whiskies of the Glen website whiskiesoftheglen.com.
- The Buyer acknowledges that Whiskies of the Glen shall not be held liable for any leakages, deterioration, damages and or breakages suffered by the Goods during transit or onward shipping to the Buyer.
- Local receiving country Taxes and Duty charges may apply to Goods being shipped outside of the UK and are the responsibility of the Buyer and, in all instances, are payable by the Buyer.
- Whiskies of the Glen and its shippers reserve the right to refuse to quote for Delivery to the Buyer’s requested destination.
- Whiskies of the Glen and its shippers reserve the right to refuse to Deliver the Goods to the Buyer’s requested destination.
- In the event that Whiskies of the Glen and its shippers refuse to Deliver the Goods to the Buyer’s requested destination, the Buyer may elect to organise and carry out the insuring and shipping of the Goods with their choice of insurer and shipping agent without the assistance of Whiskies of the Glen.
- Should the Buyer elect to organise and carry out the insuring and shipping of the Goods with their choice of insurer and shipping agent without the assistance of Whiskies of the Glen, the Buyer must liaise with Whiskies of the Glen to ensure the correct dispatch of the Goods by Whiskies of the Glen to the Buyer’s elected Shipper. When applicable Whiskies of the Glen may also ship the Goods to a Whiskies of the Glen approved pick-up point within mainland UK so that the Goods may be handed over to the Buyer’s elected Shipper.
- Whiskies of the Glen’s responsibility for the Goods will cease once the Goods have been handed over to the Buyer’s elected shipper.
- Whiskies of the Glen or its agent will not carry out the Delivery of the Goods to the Buyer’s elected Shipper without Whiskies of the Glen receiving a signed delivery receipt from the Buyer’s elected Shipper.
- In this section 13 of these terms and conditions, Delivery of Whiskies of the Glen Bargain Bid Goods through Whiskies of the Glen applies to destinations other than mainland UK.
- Insurance of Goods (mainland UK and destinations other than mainland UK)
- Whiskies of the Glen will insure the Goods whilst the Goods are on any premises used by Whiskies of the Glen for the storage of the Goods.
- When the Goods are being Delivered to the Buyer at an address within mainland UK, Whiskies of the Glen will ensure that the Goods have adequate insurance cover during their transit from the premises of Whiskies of the Glen or any premises used by Whiskies of the Glen for the storage of the Goods to the agreed mainland UK delivery destination.
- When the Goods are being Delivered by Whiskies of the Glen or its agent to the Buyer at a destination address other than an address within mainland UK, insurance costs will be included, itemised and, in any instance, payable Buyer, and detailed as a part of the Total amount on the Bargain Bid member’s congratulations / delivery details page on the Whiskies of the Glen website whiskiesoftheglen.com.
- Having received the Goods and in the event that the Buyer wishes to cancel their purchase and return the goods to Whiskies of the Glen, it is the responsibility of the Buyer to ensure that the Goods have adequate insurance cover in place for loss or damage when being shipped from the Buyer’s premises (wherever in the world the Buyer’s premises may be) to the premises of Whiskies of the Glen. Whiskies of the Glen reserves the right to check the Buyer’s insurance cover note prior to the Buyer shipping the Goods from the Buyer’s premises back to Whiskies of the Glen’s premises.
- Cancellation by the Buyer
- Whiskies of the Glen complies with the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.
- Cancellation by Whiskies of the Glen
- Whiskies of the Glen reserves the right to cancel the offering of any Identified Whiskies of the Glen Bargain Bid via a Whiskies of the Glen website, Whiskies of the Glen Email, or Whiskies of the Glen Internet Account if; (a) The seller of the Goods withdraws the Goods (b) The seller of the Goods is in breach of its contact and terms and conditions with Whiskies of the Glen; or (c) The seller of the Goods goes into administration, bankruptcy, or subject to similar proceedings.
- Whiskies of the Glen reserves the right to cancel the purchase of Goods by a Buyer via a Whiskies of the Glen website. Whiskies of the Glen Email, or Whiskies of the Glen Internet Account if; (a) The Buyer is in breach of these terms and conditions, the terms of use of the Whiskies of the Glen Website, the privacy policy of the Whiskies of the Glen Website, or the Cookie policy of the Whiskies of the Glen Website, (b) failure by the Buyer to pay in full for a Bargain Bid; or (c) The Buyer goes into administration, bankruptcy, or is subject to similar proceedings.
- If Whiskies of the Glen has cancelled or terminated a contract with a Seller or a Buyer, it reserves the right to prohibit the Seller or Buyer from using the Whiskies of the Glen Website and any of the services offered by Whiskies of the Glen.
- Returns and refunds
- Whiskies of the Glen will only Refund monies paid for Goods if the Goods are returned to Whiskies of the Glen in their original Whiskies of the Glen shipment condition and packaging and without the Goods having been tampered with, damaged, or altered in any way by the Buyer prior to their return to Whiskies of the Glen.
- Prior to making any arrangements for the return of the Goods to Whiskies of the Glen, The Buyer should evidence the condition of the Goods by taking a number of photographs of the Goods and attaching them to an email addressed to Whiskies of the Glen; the email must also contain full details of the Buyer’s reason for the return of the Goods and must be emailed to the email address enquiry@whiskiesoftheglen.com. The photographs of the Goods should include photographs taken from the 1) Front. 2) side (right). 3) Side (left). 4) Back. 5) The top or seal. 6) The bottom or base. 7). Directly above. 8). Above and front, above and rear, above and side (right), above and side (left). 9). Below.
- Whiskies of the Glen reserves the right to refuse the return of the Goods by the Buyer to it based on the email evidence provided by the Buyer, and will notify the Buyer of its decision to accept or refuse the return of the Goods by email to the Buyer within forty eight (48) hours of its receipt of the Buyer’s evidence email, at the email address the Buyer has registered with Whiskies of the Glen in their Bargain Bid Account.
- Whiskies of the Glen will pay any refunds it deems as due to the Buyer within 14 days of It receiving the Goods, and upon It’s email confirmation to the Buyer that the Goods received by it are in their original Whiskies of the Glen shipment condition and packaging and that the Goods meet the strict provision that the Goods have not been tampered with, damaged, or altered in any way by the Buyer prior to their return to Whiskies of the Glen.
- Whiskies of the Glen provides all Goods as detailed in the description presented on the Whiskies of the Glen Website. Should the Goods not meet the description as stated on the Whiskies of the Glen Website, the Buyer should immediately return the Goods to Whiskies of the Glen in their original Whiskies of the Glen shipment condition and packaging ensuring the Goods meet the strict provision that the Goods have not been tampered with, damaged, or altered in any way by the Buyer prior to their return to Whiskies of the Glen, and stating that they are not as described by Whiskies of the Glen. These terms and conditions do not affect the Buyer’s rights to cancel consumer contracts.
- In the event that the Buyer has received the Goods and is returning the Goods to Whiskies of the Glen, upon receipt of such returned Goods, Whiskies of the Glen will send to the Buyer a confirmation email stating that the Goods have been received by Whiskies of the Glen. Whiskies of the Glen will then ascertain that the Goods have not been damaged, altered, or tampered with by the Buyer prior to their return to Whiskies of the Glen. Upon email confirmation to the Buyer by Whiskies of the Glen that the returned Goods received by Whiskies of the Glen from the Buyer, have not been damaged, altered, or tampered with in any way by the Buyer prior to their return to Whiskies of the Glen, and no later than fourteen (14) days from the day of the Whiskies of the Glen email to the Buyer confirming that the Goods have been received by Whiskies of the Glen and have not been damaged, altered, or tampered with in any way by the Buyer prior to their return to Whiskies of the Glen, Whiskies of the Glen will credit any sum it has debited from the debit or credit card of the Buyer as payment for the Goods to the account the payment originated from. If the Buyer has paid for the goods by bank transfer, Whiskies of the Glen will, within the same time period of fourteen (14) days from the day of its confirmation email to the Buyer stating that the Goods have been received by Whiskies of the Glen and have not been damaged, altered, or tampered with in any way by the Buyer prior to their return to Whiskies of the Glen, credit the Buyer’s transferring bank account with the sum transferred to it as payment for the Goods by the Buyer.
- If the Buyer wishes to cancel a Bid, Please see section 5.
- Liability
- Whiskies of the Glen makes no warranties, express or implied, regarding the Goods including those of merchantability or fitness for display or sale. Whiskies of the Glen shall have no liability for any damages, whether direct, indirect, general, special, incidental, exemplary or consequential, or for any deficiency or defect therein, or for the use or maintenance thereof, or for any repairs, or for any loss of business or any damage or injury whatsoever and however caused.
- In the event of a Buyer making a claim, and solely for that specific claim, Whiskies of the Glen limits its liability to the total sum paid to It for the item or Goods by the Buyer.
- Our Rights
- Whiskies of the Glen reserves the right to reject or cancel the registration of any person or Buyer.
- Whiskies of the Glen reserves the right to prohibit any person or Buyer from purchasing Goods through Whiskies of the Glen, it’s Website, or associate companies for any reason.
- Whiskies of the Glen reserves the right to change or update these terms and conditions from time to time and at any time.
- Indemnity
- The Buyer assumes all liability for the Goods they have purchased and paid in full for from a Whiskies of the Glen Bargain Bid, and they shall indemnify Whiskies of the Glen and its agents, successors and assigns harmless from and against any and all losses, damages, liabilities, obligations, judgments, settlements, costs and other expenses incurred or suffered by the Buyer, by reason of the assertion of any claim or the institution of any litigation against them at any time, directly or indirectly relating to or arising out of the onward sale, use, transportation, delivery, ownership, possession, storage, return or condition of the Goods (regardless of whether the Goods are at the time in the possession of the Buyer) or of the Buyer’s failure to comply with the terms of this agreement.
- Notices
- Any notices or demands required or permitted hereunder shall be given to Whiskies of the Glen or the Buyer in writing and by personal delivery by courier, mail or registered mail, facsimile, or email. Such notices or demands shall be deemed given upon receipt in the case of personal delivery, and upon mailing or transmission in the case of mail, facsimile, or email.
- Waiver
- Failure by Whiskies of the Glen to enforce any of these terms and conditions shall not be considered or construed as Whiskies of the Glen waiving its rights herein and shall not affect the validity of these terms and conditions or the right of Whiskies of the Glen to enforce them thereafter. None of the provisions of this agreement may be amended, modified, or waived except in writing and approved and signed by Whiskies of the Glen.
- Entire Agreement
- This agreement constitutes the entire agreement between the parties.
- Governing Law
- All contracts with the Customer are made pursuant to these Terms and Conditions, which are made under the laws of England and Wales. The Customer agrees to the exclusive jurisdiction of the Courts of England and Wales.
